1. Who we are
YesBrainer is operated by Antonius Janssen, Djambistraat 20 H, 1094AZ Amsterdam, The Netherlands ("we", "us", "our"). By purchasing or using YesBrainer you agree to these Terms & Conditions.
2. Acceptance
By accessing, downloading, or using YesBrainer, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, do not use the software.
3. Product description
YesBrainer is a desktop application that provides multi-lens analytical thinking. It runs entirely offline on your own hardware. A one-time license purchase grants perpetual access on unlimited personal devices.
4. License
We grant you a limited, non-exclusive, non-transferable, perpetual license to use YesBrainer for personal and commercial purposes. You may install it on unlimited devices that you own or control. You retain full commercial ownership of any output you create with the software.
5. Restrictions
You may not:
- Reverse-engineer, decompile, or disassemble the software
- Redistribute, resell, sublicense, or share your license with third parties
- Circumvent any technical limitations or protections
- Use YesBrainer for any unlawful purpose
6. Misuse
You must not misuse YesBrainer or our services. This includes, but is not limited to: unlawful use, fraud, spam, intellectual-property infringement, distributing malware, attempting to probe or compromise security, or automated scraping.
7. Intellectual property
All intellectual property in YesBrainer — including but not limited to the software, documentation, design, and branding — remains our exclusive property. Your license does not transfer any ownership rights.
8. Payment & billing
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Please refer to Paddle's Buyer Terms for payment, billing, tax, and refund mechanics.
9. Service level
YesBrainer is provided "as is". We do not guarantee uninterrupted or error-free performance. Because the software runs offline, availability depends on your own hardware and operating system.
10. Warranties
To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
Our aggregate liability for any claims arising from or related to YesBrainer shall not exceed the amount you paid for the license. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury caused by negligence where required by law.
12. Suspension & termination
We may suspend or revoke your license if you materially breach these terms, engage in fraud or security-threatening behaviour, or repeatedly violate our policies.
13. Governing law
These terms are governed by the laws of The Netherlands. Any disputes shall be submitted to the competent courts in Amsterdam.
